    NEW JERSEY RESIDENTS MISSING OPPORTUNITY TO SELECT THE RIGHT AUTOMOBILE INSURANCE

    UNCLEAR OF VERBAL THRESHOLD VS. ZERO THRESHOLD INSURANCE OPTIONS

    There are countless automobile insurance companies in New Jersey offering a variety of insurance plans. But one option many people are unaware of, and insurance companies often neglect to fully explain is the Verbal or Limitation on Lawsuit Threshold option.

    Most consumers who purchase car insurance assume they have all the coverage needed to cover the cost for any personal injury to them or anyone involved in a car accident. But they do not understand how insurance policies limit costs for injuries sustained.

    All New Jersey residents involved in an automobile accident have two options available to them:

    • The Verbal or Limitation on Law Suit Threshold; or
    • The “0″ Threshold or the No Limitation on Law Suit Threshold.
    The Verbal Threshold or the Limitation on Law Suit Threshold carries restrictions on a victim’s rights when filing a lawsuit for non-economic damages as a result of being involved in a motor vehicle accident. It basically requires the injuries sustained to be permanent.

    The “0″ threshold permits an injured party to sue for non-economic damages such as pain and suffering without any limitation.

    It is vital that consumers understand exactly what the differences in these two options.

    “Most insurance carriers do not spell out the option of No Limitation Policies”, Patrick Masterpalo of Dimian and Masterpalo Attorneys At Law stated. The most common injuries from car accidents are soft tissue injuries to the neck and back spinal areas. These types of cases typically are denied by insurance companies and have to go to litigation. If you want to maintain your full rights to sue for all types of injuries, it is important you select the “no limit lawsuit” or Zero Threshold option when choosing your insurance policy, Masterpalo added.

    WHAT THE DIFFERENCE MEANS TO YOU.
    With the Verbal Threshold option, generally, in order to recover for pain and suffering damages, the injuries must meet or fall into one of the following types or categories:

    Type 1 – Death
    Type 2 – Dismemberment
    Type 3 – Significant disfigurement or scarring
    Type 4 – Displaced fracture
    Type 5 – Loss of a fetus
    Type 6 – Permanent injury
    The Zero Threshold option takes away those restrictions and allows the insured to receive compensation for any injuries sustained.

    While the Verbal Threshold is generally cheaper than the Zero Threshold option, many people choose it without thinking of what it means in terms of their rights should they be in an accident.

    “No one thinks they will be in a car accident, so they often choose the cheaper option, especially since most insurance companies really don’t explain these options. What they don’t realize is by choosing Verbal Threshold they are greatly reducing the opportunity to recover for pain and suffering if injured in a motor vehicle accident,” added Steven Dimian, partner at Dimian & Masterpalo.
